ILoveB ECommerce is an online store that sells products related to boomerangs.

The purpose of these general conditions of sale is to regulate the sale and delivery of Products ordered from ILoveB ECommerce through the Site.

Any order placed on the Site necessarily implies the unconditional acceptance by the Customer of these general conditions.

Subject

These General Conditions govern the sale of Products by ILoveB ECommerce through the Site.

The Client is clearly informed and acknowledges that the Site is intended solely for consumers.

Acceptance of the general conditions

 ILoveB ECommerce advises the Customer to read the General Conditions for each new Order, the latest version of these Conditions being applicable to any new Product Order.

Purchase of products on the SITE

Registration procedure

The Client has the option of creating an Account in his name, which allows him to manage Product Orders.

At the end of this process, the Client will receive an email confirming the registration.

Clients guarantee that all the information they provide on the registration form is accurate, up-to-date and honest, and is not tainted by any misleading nature.

They undertake to immediately update this information in your Account in the event of any change, so that they always correspond to the aforementioned criteria.

Clients are informed and accept that the information entered for the purpose of creating or updating their Account constitutes proof of their identity. The information entered by the Clients links them as soon as they are validated.

The Account allows the Client to consult their Orders placed on the Site and to follow the Delivery of the Products. Identifier Management

The Client will be solely responsible for the use of their Identifiers or the actions carried out through their Account. 

In the event that a Customer discloses or uses their Identifiers in a manner contrary to its intended purpose, ILoveB ECommerce may terminate access to the Account without prior notice or compensation. 

In any case, ILoveB ECommerce is not responsible in case of theft of a Client’s identity. Any access and action that is carried out from the Account of a Client will be presumed carried out by this Client, to the extent that ILoveB ECommerce has no obligation and does not have the technical means that allow it to verify the identity of the people with access to the Bill.

Unsubscribe 

The Customer can close his Account at any time by sending an email to the address: shop@iloveboomerangs.com

 ILoveB ECommerce will deactivate the Account as soon as possible and will send the Customer an email confirming the closure. 

In the case of Orders in progress, these must be paid by the Client and delivered by ILoveB ECommerce.

Orders

Product Characteristics

ILoveB ECommerce undertakes to present the essential characteristics of the Products and the mandatory information that the Customer must receive according to applicable law.

These characteristics and information appear in the product sheets of the Site and contain in particular the description, photographs, composition, price, packaging of the Products and suggestions for use.

The Customer agrees to read this information carefully before placing an Order on the Site.

Order procedure 

Product orders are placed directly on the Site. To place an order, the customer must follow the steps outlined below (note, however, that depending on the customer’s home page, the steps may differ slightly).

Selection of Products and purchase options

The Customer must select the Product (s) of their choice by clicking on the Product (s) in question and choosing the desired characteristics and quantities. Orders

Product availability

In any case, if unavailability was not indicated at the time of the Order, ILoveB ECommerce undertakes to inform the Customer without delay if the Product is not available.

In the event that a Product is not available, ILoveB ECommerce may, and if the parties agree:

  • Keep the Order and modify the delivery date;
  • Offer an alternative Product of equivalent quality and price, accepted by the Client;

Right of withdrawal

Payment

Means of payment

Therefore, it is specified that all payment information provided on the Site is transmitted to the Site’s bank and is not processed on the Site.

Payment date

In the case of a one-time payment by credit card, the Customer’s account will be debited as soon as the Product Order is placed on the Site.

Refusal of payment

Any contract entered into with the Client corresponding to an order for an amount greater than 120 euros including taxes will be archived by ILoveB ECommerce  for a period of ten (10) years in accordance with article L. 213-1 of the Consumer Code.

Transfer of ownership

Delivery

The Product Delivery terms are established in the “ delivery policy ” referred to in Appendix 2 hereof.

Packaging

The Products will be packed in accordance with current transport regulations, in order to guarantee the maximum protection of the Products during Delivery as well as their conservation at the appropriate temperature.  

Clients undertake to comply with the same standards when returning Products under the conditions established in Annex 1 – Withdrawal Policy.

Guarantees

Apart from the commercial guarantees that ILoveB ECommerce  could offer for certain Products, any Client benefits from “legal” guarantees, for all Products, which are detailed below.

Guarantee of conformity

Article L. 217-4 of the Consumer Code: “The seller delivers the goods in accordance with the contract and is responsible for any lack of conformity existing at the time of delivery.

It also responds to the lack of conformity derived from the packaging, the assembly instructions or the installation when it has been in charge of the contract or has been carried out under its responsibility.

The action resulting from the lack of conformity expires two (2) years after the delivery of the Product. (Article L.217-12 of the Consumer Code)

In the event of lack of conformity, the Customer may request the replacement or repair of the Product, at their option. However, if the cost of the Customer’s choice is manifestly disproportionate with respect to the other possible option, taking into account the value of the Product or the importance of the defect, ILoveB ECommerce  may proceed with the return, without following the option chosen by the Customer.

In case replacement or repair is impossible, ILoveB ECommerce  undertakes to return the price of the PRODUCT within thirty (30) days following receipt of the returned PRODUCT and in exchange for the return of the Product by the CLIENT.

In case replacement or repair is impossible, ILoveB ECommerce  undertakes to return the price of the Product within thirty (30) days after receipt of the returned Product and in exchange for the return of the Product by the Customer.The action resulting from inhibitory defects must be initiated by the Client within two (2) years from the discovery of the defect. (Paragraph1 of article 1648 of the Civil Code)

Liability

Liability of ILoveB ECommerce  In no case may it be committed in the event of breach or improper fulfillment of the contractual obligations attributable to the Client, in particular at the time of formalizing the Order.

 ILoveB ECOMMERCE  It is not responsible, nor is it considered to have failed in these conditions, for any delay or non-compliance, when the cause of the delay or non-compliance is related to a case of force majeure as defined by the jurisprudence of the French courts and tribunals.

Consequently, it excludes all responsibility for the information published there. Links to third party websites are provided for informational purposes only and no guarantee is made as to their content.

FORCE MAJEURE

There is force majeure in contractual matters when an event beyond the control of the debtor, which could not reasonably be foreseen at the time of the conclusion of the contract and whose effects cannot be avoided with the appropriate measures, prevents the fulfillment of its obligation. the debtor.

If the impediment is temporary, the fulfillment of the obligation is suspended unless the resulting delay justifies the termination of the contract. All conditions not expressly addressed in this document will be governed in accordance with the practice of the retail sector, for companies whose main office is in France.

Modification of the General

Mediation is not mandatory, the Client or ILoveB ECOMMERCE may at any time withdraw from the process.

In the event that the mediation fails or is not considered, the litigation that led to the mediation will be entrusted to the competent court designated above.

WITHDRAWAL POLICY

However, in accordance with article L.221-28 of the Consumer Code, it is recalled that the right of withdrawal does not apply to ILoveB ECOMMERCE Products that: on request

Principle of withdrawal

In order for the withdrawal period to be respected, the Customer must send his communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of withdrawal

In the event of withdrawal by the Customer, ILoveB ECOMMERCE undertakes to reimburse all sums paid, including shipping costs, without undue delay, and at the latest within fourteen (14) days from the date on which it is informed. Customer withdrawal decision (article L.221-24 of the Consumer Code).

Unless you offer to collect the Products yourself, ILoveB ECOMMERCE may defer the reimbursement until the recovery of the Products or until the consumer has provided proof of shipment of the Products, the date selected being the first of these events.

ILoveB ECOMMERCE will proceed to the reimbursement using the same means of payment that the Client has used for the initial transaction, unless the Client expressly agrees to use another means of payment and insofar as the reimbursement does not involve costs. for the customer.

Return conditions

The Customer must in any case, no later than fourteen (14) days after the communication of his decision to withdraw from this contract, return the merchandise to ILoveB ECOMMERCE at the address indicated.

This period is considered fulfilled if the Customer returns the merchandise before the expiration of the fourteen (14) day period.

Return costs

The Customer must bear the direct costs of returning the merchandise.

Condition of the returned item

The Product must be returned in accordance with the instructions of ILoveB ECOMMERCE and include in particular all the accessories delivered.

The Customer is only responsible for the depreciation of the good resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of this Product. In other words, the Customer has the possibility to test the Product but his responsibility could be compromised if he carries out manipulations other than those necessary.

Exclusions of the right of withdrawalright of withdrawal

APPENDIX 2: DELIVERY POLICY

Delivery area

For deliveries in overseas departments and territories and outside Europe: Customs duties or local taxes, import duties or state taxes may be paid. These rights and amounts are the sole responsibility of the Client.

It is also the Customer’s responsibility to check with local authorities for any import restrictions on the products he plans to order.

In case of return of a package for customs reasons, no refund will be made.

The Products are sent to the delivery address (es) that the Customer will have indicated during the order process.

Shipping

deadlines The deadlines for preparing an order and then establishing the invoice, prior to the dispatch of the Products in stock are mentioned on the Site. It is understood that these periods exclude weekends or holidays and exclude customs periods.

An email will be automatically sent to the Customer at the time the Products are shipped, provided that the email address that appears on the registration form is correct.

Delivery times and costs

During the order process, ILoveB ECOMMERCE indicates to the Customer the possible delivery times and formulas for the products purchased.

Shipping costs are calculated based on the shipping method, the weight of the package and the delivery address.

The total weight per package is limited to a maximum of 10 kilos. Beyond that, additional packages will be billed at the actual weight. 

The amount of these costs will be borne by the Customer in addition to the price of the Products purchased.

DELIVERY problems

The Customer is informed of the delivery date set when he chooses the carrier, at the end of the online ordering procedure, before confirming the Order.

It is specified that deliveries will be made within a maximum period of thirty (30) days. Otherwise, the Client must formally notify ILoveB ECOMMERCE of the delivery within a reasonable period of time and, in the event of non-delivery within this period, they may terminate the contract.

ILoveB ECOMMERCE will reimburse, without undue delay from receipt of the termination letter, to the Customer the total amount paid for the Products, including taxes and shipping costs, using the same payment method as the one used by the Customer to purchase the products. 

ILoveB ECOMMERCE is responsible until the delivery of the Product to the Client. It is recalled that the Customer has a period of three (3) days to notify the carrier of the partial damages or losses noted during the Delivery.
